Terms of sale for used, one-of-one pieces from Merchant of Oz.

The contract

These terms cover use of merchantofoz.com and any sale of a piece from Merchant of Oz. Using the site or placing an order means you accept them.

Sales of goods are under the Arkansas Uniform Commercial Code. Used pieces are sold AS IS and WITH ALL FAULTS. That language is the ordinary UCC § 2-316 way to exclude implied warranties of merchantability and fitness, to the extent Arkansas law allows. We do not give a written product warranty.

The pieces

Each listing is used and one of one. Photos help you see the piece. They are not a new-goods guarantee. Condition is as shown and as described.

Prices stay unlisted until a piece is ready. Availability can change. A sold mark means that piece is gone.

Orders and payment

Checkout is invoice-only. A card processor is not connected. An order is not placed unless the invoice is accepted and staff confirm it.

Pay the invoice as written. Staff mark the order paid after that. We can cancel an unpaid or incomplete order.

Shipping

We ship to the address you give. Risk of loss passes when we hand the piece to the carrier, unless Arkansas law says otherwise. Tracking follows when a piece actually moves.

Returns

Sales are final unless we agree in writing to something else. If we sent the wrong piece, write us through the site and we will make it right.

The site

The site is provided as available. Staff tools, inventory numbers, and the Coming soon gate can change.

Liability

To the fullest extent Arkansas law allows, our liability for a piece is limited to the amount you paid us for that piece. We are not liable for indirect or incidental losses.

Some rules cannot be waived. Nothing here takes away a right you cannot give up.

Law

Arkansas law governs these terms, without a conflict-of-law rule that would send the case elsewhere. Courts in Arkansas may hear disputes about the shop or a sale.
